When you visit our website https://www.codijy.com/ (“Site”) and use our products and services, you trust us with your personal information. We take your privacy very seriously. In this privacy notice, we describe our privacy policy. We seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it. We hope you take some time to read through it carefully, as it is important. If there are any terms in this privacy policy that you do not agree with, please discontinue use of our site and our services.

 

This privacy policy applies to all information collected through our website https://www.codijy.com/, CODIJY Software (“Software“), and/or any related services (we refer to them collectively in this privacy policy as the “Services“).

Please read this privacy policy carefully as it will help you make informed decisions about sharing your personal information with us. 

1. GENERAL

Regarding the Services: CODIJY (“CODIJY“, “we“, “us” or “our“) is the Data Controller within the meaning of the General Data Protection Regulation (“GDPR“).

This privacy policy shall inform you on how we collect, process and use (“Use“) personal data in connection with the Services.

2. Personal Data Collection & Use

In Short: We collect Personal Information that you provide to us such as your name and email address .

2.1 In general, we collect Personal Information that you voluntarily provide to us when you ask us about our products and services, download, purchase and registere our Software, sunscribe to our mailing lists and contact us for any other reason. 

2.2 The personal information we collect can include the following:

2.2.1 Regarding the Download of the Trial Version of Our Software.  You can download the trial version of our software from the desktop version of our website without providing us with your Personal Information. Only in cases when access our website from the mobile device or want to  recieve the download information by email, we ask you to provide us with your email address. so that we can send you the download links. We will use your email address to send you a one-time email with requested information and will remove it 15 days (the estimated term of the trial period) afterwards. 

2.2.2 Regarding Subscription Links in the email messages. Our service email messages (including emails with trial links and emails with the educational course) contain invitation to subscribe to Our mailing lists including but not limited to Product Newsletter, Colorization Course and Colorization Digest. If you click the subscription link in one of Our email messages, you grant us the right to add the email address, we used to sent you this message, to the selected mailing list. After you opt-in,  we will send you the requested mailings in the amount and on the schedule that were clearly described. Each of email messages contain the unsubscribe information and let you unsubscribe from this partucular mailing list any time.  

2.2.3 Regarding Subscription Forms on our Website. Our website contains Subscription forms including but not limited to our Product Newsletter, Colorization Course and Colorization Digest. If you enter your email address in one of of the Subscription forms on Our website, we will send you the opt-in link to receive your informed concent for adding your email to the selected mailing list. By clicking the link in the opt-in email, you allow us to add the provided email address to the requested mailing list and send you the email newsletters in the amount and on the schedule clearly described the description for this Subscription. Each of the messages sent to our mailing lists contain the unsubscribe information, so that you can remove your information from this particular mailing list any time.

2.2.4 Regarding Purchasing of Software. Every time you decide to purchase our software or services, we redirect you to the website of PayProGlobal Inc. (“Ecommerce Provider”). We entitle Our Ecommerce Provider to process and fulfill the orders of Our Software on our behalf. The Ecommerce Provider will collect and process your Personal Information and payment details for the purpose of processing and fulfilling your order. All information that you provide to Pay pro Global Inc. is protected under the following Privacy policy terms: https://docs.payproglobal.com/documents/legal/privacyPolicy.pdf  We receive information about the successfully processed orders and collect your First Name, Last Name and Email Address to fulfill our obligations and provide you with the services unders the terms and conditions listed in the End User License Agreement. 

2.2.5 Regarding the Software Registration. You can register our software without providing your email address. In case you choose to enter your email address in the Registration Dialog of the Software, we will use it solely for the purpose to locate and retrieve your serial number, in case you forward us the related request from the same email address.  

2.2.6 Technical support and contacting us. We collect your your Email address, and other information you choose to provide to us, when you contact us via email, Website Contact Form or the Contact Form built into  Software. We use the provided information to answer your questions or provide you with requested services. We will collect and store this information for future reference.  

2.2.7 Update Notifications. Our Software features the built-in Automatic Update Notifications that allow you to timely receive notifications about new  versions and access the download links or pages, directly in your copy of Software. To draw information about the availbility of new version, Software  will connect to our server, every time you launch it. When we recieve suich query we collect your IP address. We use it for cumulative statistical analysis to evaluate the usage of our software in different regions and tailor our services in these regiouns accordingly.  We do not match this information with your Personal Data with the purpose to identify you or track your individual behavior in any form. If you wish that the Software stopped connecting to our servers, you can disable Update Notifications in Preferences -> Tools.  

The legal basis for the processing of the data described above in section 2.2.1 through 2.2.7 (to the extent such data is to be considered Personal Data) is Art. 6 (1) sentence 1 lit. f GDPR (legitimate interests; regarding section 2.2.1 the legitimate interests to Use such data is to provide your with evaluation copies, in cases when the instant download is possible or for the link back up purposes  2.2.2-2.2.3 the legitimate interests to Use such data is that We need to provide our users with product information, education or informational services; regarding section 2.2.4-2.2.6 the legitimate reason is that we need to provide you with support and perform our obligations under the Terms & Consitions of the End user License Agreement 2.2.8 the legitimate reason is that we need the information to improve our services on the regional markets).

2.3 Only in cases in which you have given us prior consent we also use your Personal Data for other purposes but only to the extent needed in each specific case. The legal basis for the processing of the data described in this section 2.3 is Art. 6 (1) sentence 1 lit. a GDPR (consent).

2.4 We may disclose Personal Data to third parties where such disclosure is required by law (for example, upon request of a court or of law enforcement authorities). The legal basis for the processing of the data described in this section 2.4 is Art. 6 (1) sentence 1 lit. c GDPR (legal obligation).

2.5 We may also Use certain data as set forth in section 3 below.

3. CODIJY’S COOKIES POLICY

In Short: We collect personal information that you provide to us such as your name email address billing and postal address .

3.1 CODIJY Website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help analyze how you use the Website. The information generated by the cookie about your use of the Website will normally be transmitted to and stored by Google on servers in the United States.

If the IP-anonymization is activated on the Website, your IP address will be truncated within the area of member states of the European Union or within other contracting states to the Agreement on the European Economic Area. Only in exceptional cases the whole IP address will be first transferred to a Google server in the USA and truncated there. Google will use this information on behalf of CODIJY for the purpose of evaluating your use of the Website, compiling reports on Website activity and providing other services for CODIJY relating to website activity and internet usage.

The IP address that your browser transfers within the scope of Google Analytics will not be associated with any other data held by Google.

You may refuse the use of cookies by selecting the appropriate settings in your browser, however please note that if you do so you may not be able to use all functions of the Website. You can also opt-out from the storage by Google of the data that is created by the cookie and is related to the use of the Website (including your IP address) and the processing of such data by Google by downloading and installing the Google Analytics opt-out Browser add-on available under https://tools.google.com/dlpage/gaoptout?hl=en.

As an alternative to the browser add-on or within browsers on mobile devices, you can click this link in order to opt-out from being tracked by Google Analytics within this Website in the future (this opt-out option applies only for the browser in which you set it and with regard to the Website).  3.2 The legal basis for the processing of the data described in this section 3 (to the extent such data is to be considered Personal Data) is Art. 6 (1) sentence 1 lit. f GDPR (legitimate interests; the legitimate interests to Use such data is that we use and analyze the respective data to improve our Services, such as by gaining a better understanding of your interests and requirements regarding our Services and to help personalize your user experience).

4. International Information Transfers

In Short: We may transfer, store, and process your information in countries other than your own.

Our servers are located in the United Stated. If you are accessing our Website from outside the United States, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties whom we appoint to fulfill particualr services on Our Behalf (see “Personal Data Collection and Use” above).

If you are a resident in the European Economic Area, then these countries may not have data protection or other laws as comprehensive as those in your country. We will however take all necessary measures to protect your personal information in accordance with this privacy policy and applicable law.

The European Commission’s Standard Contractual Clauses concerning the transfers of personal data require all such recipients to protect personal information that they process from the EEA in accordance with European data protection laws. We implemented such safeguards with our third party service providers and partners and further details can be provided upon request.

5. DURATION OF STORAGE OF PERSONAL DATA

Unless no shorter storage period is indicated in this privacy policy, we, in general, store Personal Data as long (i) as required for the provision of the Services to you, and/or (ii) as it is necessary with regard to the contractual relationship with you, thereafter only if and to the extent that we are obliged to do so by mandatory statutory retention obligations. If we no longer require the respective Personal Data for the purposes described above, such Personal Data will only be stored during the respective legal retention period and not processed for other purposes.

6. YOUR RIGHTS

You have the right to request information from us at any time about your Personal Data stored by us. If the legal requirements are met, you also have rights vis-à-vis us to request from us access to and rectification or erasure or restriction of processing concerning your Personal Data or to object the processing of your Personal Data as well as the right to receive your Personal Data provided to us in a structured, established and machine-readable format from us (you can transfer this data to other parties or have it transferred; data portability).

If you have given your consent to the use of personal data, you can revoke such consent at any time (for the future).

If you believe that the processing of your Personal Data by us is in breach of the applicable data protection laws, you can issue a complaint with the competent supervisory authority for data protection.

6. KEEPING YOUR PERSONAL DATA SECURE

We have taken extensive technical and operational precautions to protect the Personal Data retained by us against unauthorized access and misuse. Our security procedures are revised regularly and adapted to reflect technological progress.

7. CALIFORNIA RESIDENTS NOTICE

In relation to paragraph (5), s.1798.130 of California Consumer Privacy Act of 2018 (CCPA):

  • following subparagraph (A) the list of consumer rights can be found in section 6 above;
  • following subparagraph (B) personal information categories that We collect or have collected about consumers in the preceding 12 months can be found in section 2 and 3 above;
  • subparagraph (C) does not apply to our practices as We neither sell nor have in the past 12 months sold your personal information as described in subdivision (t) of s.1798.140 CCPA.
